The Legal Stuff

 Please ensure that you read the Terms and Conditions below as it contains very important information regarding your order.


I am fully insured with public liability insurance, I am registered with East Hampshire District Council and have a 5 star Hygiene rating. I have a current level 2 food hygiene qualification and renew this training every 2 years or when legislation changes deem it necessary to refresh the training.  This also applies to allergen training which is refreshed every 2 years or when legislation changes whichever is sooner

Terms and Conditions

1. Booking your cake.

          1.1. Following your consultation/enquiry, you will be issued with a tailored quote along with a sketch of your cake. Your quote is valid for 1 month, paying your initial payment (section 3.1) secures this price and prevents any further price increases, except in exceptional circumstances beyond our control. The images and sketches provided by Cakey Bakey Creations containing the company watermark remain the property of Cakey Bakey Creations (hereafter known as “the company” “we” or “us”) and are not to be distributed whether by social media or communication lines without prior consent of the company.


2. Securing a date

          2.1. If you wish to secure a date for an event such as a wedding but have not yet decided on a cake design a “save the date” booking can be made with a £50 deposit which remains refundable until 3 months prior to the event after this time the payment is non-refundable. If you decide to cancel the event/cake, please see section 4. Dates for the event can be changed up to 4 months prior to the original date depending on the availability of the company. The final design and price of the cake needs to be finalised 2 months prior to the event and any subsequent changes to design, colour or flavour, thereafter, remains at the discretion to the company.


3. Payments

          3.1. Payments are divided into 2 parts, Part 1: Initial Payment which is 50% of the total invoice, Part 2: Final Payment remaining 50% of the total invoice.

            3.2. A non-refundable 50% initial payment is required to secure the commission of your cake and chosen date. The details will be set out in a payment schedule on your quote/invoice. Orders with less than 14 days to the event will require full payment, unless otherwise agreed by us.  Payment of the "initial payment" is agreeing to the terms and conditions set out in this document.

          3.3. Payment is to be made via bank transfer; details will be sent out with your invoice/quote contained in the payment schedule section. Please email/message us with confirmation of payment whereupon we will confirm receipt of monies and issue a receipt if you require one. Final payment for your cake is also laid out in the payment schedule. If your initial payment is not paid within the times laid out in the payment schedule of your invoice/quote, we reserve the right to cancel any previous arrangements. If full/final payment is not received and cleared in our account the day after the final payment schedule date, the order will not be released until full payment is made.


4. Cancellation

          4.1. Cancellation of a “save the date” booking. If the event is cancelled with not less than 3 months prior to the event date your £50 payment will be refunded less than 3 months to the event the payment will not be refunded.

       4.2. For all other bookings, if cancellation of your event takes place before your final payment date, as laid out in the payment schedule, we reserve the right to keep 100% of the initial payment which is 50% of the total invoice price. If cancellation of your event happens after your final payment but with more than 2 weeks to the event, we will continue to keep 100% of the initial payment and 50% of the final payment. With 7 days or less to the event we will keep 100% of initial and final payments.

       4.3. Cancellation must be made in writing to the company and will only be deemed to take effect from the date your communication is received. If you postpone the event, we will endeavour to transfer your order providing the date is suitable for ourselves, otherwise it shall be treated as a cancellation.

          4.4. We reserve the right to cancel the booking in very unusual circumstances beyond our control, such as fire or ill health, during which we will refund all monies in full.


5. Amendments

       5.1. It is your responsibility to read and check the quote/invoice thoroughly; any amendments are to be made in writing. If requested, we will endeavour to adjust the design where possible, but sometimes this is not possible according to the nature of the request or amount of notice given. If the alteration affects the cost, or preparation work for the original design has already been undertaken, then your balance will be adjusted accordingly.


6. Copying

          6.1. Copying a cake from another maker is difficult as their skills are completely different. Any cake ordered from a picture or photo of a cake produced by any other cake maker can be used as inspiration for your cake and will not be an exact reproduction of the cake in the picture or photo. We will add our own artistic elements to the cake. Please bear in mind that colours from digital photos will differ from the true colour in daylight. Your cake will never be an exact copy in this instance we will endeavour to contact the original cake maker and acquire their blessing to reproduce their cake and credit them with the original design.


7. Weather

          7.1. We cannot be held responsible for flowers or model elements softening or drooping if the cake is situated in an outdoor event. We will of course advise the best conditions for your cake, but the final location of your cake is your decision and you take full responsibility for any spoilage that may occur.

          7.2. Extreme caution is needed if you are considering a cake decorated with chocolate or buttercream for an event during hot weather. We cannot accept responsibility for any melting of a cake once it has left our possession. We have no control over the environment/venue temperature. We can however advise you of designs that are less susceptible to melting and make suggestions for a more suitable cake for your occasion. Naked cakes will also have a very reduced shelf life in hot weather and especially if they are outside.


8. Non-Edible Items

          8.1. Most cakes contain small proportions of inedible items, e.g., support dowels in tiered cakes, ribbon, toppers, wires in sugar flowers and internal supports for figures. It is your responsibility to ensure these are removed by you, your caterer and/or your guests are informed before consumption.

          8.2. If fresh flowers are being used on a cake it is the responsibility of the florist to determine flower safety and safe food practices regarding pesticides or potential pests in contact with food. Placement of flowers is to be a joint effort between florist and ourselves and you will need to arrange this at a mutually convenient time for both the florist and us.


9. Collection/Delivery and Set up

          9.1. If you chose to collect the cake, you will be given a half hour time slot, please ensure that you keep to this timeframe as if you miss your time slot you will be moved to the end of the queue for that day.  Due to Covid-19 pandemic we cannot have customers crossing over.  We will not be held liable for any damage to the cake once it has left our premises. We will of course advise you on the best way to transport your cake, if the cake is for a wedding and you are collecting the cake please ensure your insurance covers wedding cake damage. To ensure your cake is as fresh as possible, we recommend it is collected the day before the event.  

        9.2. Changes from collection to delivery will be accommodated where possible, but cannot be guaranteed, as earlier delivery commitments must take priority.

             9.3. Delivery charge is calculated on a mileage basis, return journey.

             9.4. It is your responsibility to ensure that you inform us of your event/reception time along with the full postal address including postcode of the venue.

          9.5. We cannot be held responsible for any delays such as traffic incidents, so we will always arrange delivery of the cake 2-3 hours prior to the event time. In some circumstances, we may recommend the cake is delivered 1 day in advance.

         9.6. We require a nominated person to be at the event to witness the delivery and set up of the cake along with signing a disclaimer for the cake and receive the allergen and structural information. We cannot be held liable for any damage that occurs to the cake at the venue once we have left the premises.

            9.7. It is your responsibility to provide a safe and sturdy table for the cake to sit on. This also includes table coverings such as clean linen. This needs to be set up before our arrival. If any delay is incurred due to these not being set-up, we reserve the right to charge for any delay incurred (labour costs at £20 per hour, plus any compensation required to pay to other customers whose cake delivery has been delayed as a result)

              9.8. If you wish for your cake to be placed on a cake stand it is your responsibility source the stand and to ensure that the stand is large enough for the cake. The cake will have display boards under it larger than the cake itself. If we feel that the stand is not suitable for the cake, we reserve the right to refuse to use it. It is also your responsibility to provide a cake knife.


10. Allergen Information and food intolerances

            10.1. It is your responsibility to inform us of any allergen or food intolerances. Cakes can be made gluten free/egg free/alcohol free/without nuts by request although these ingredients can be removed from the cakes, they are still used in our kitchens so we cannot guarantee that any of our cakes are completely free of all traces for people who are extremely sensitive.


11. Storage

           11.1. Please remember, cake decorations are very delicate items, and we cannot accept responsibility for damage that is done to the cake after it has left our possession. If any damage occurs to the cake after it has left our possession, you can contact us to request a repair, which will be costed accordingly, including transport costs if appropriate.

         11.2. If you have collected your cake in advance, please ensure cakes are placed on a secure flat surface out of the reach of children and pets. Keep the cake cool but not refrigerated unless instructed to do so, out of direct sunlight and unnecessary heat sources and in the box provided until the event.


12. Best Before Date

           12.1. Your cake is made to ensure it is fresh for the date of your event. We advise that you cut the cake on the day of your event and that you consume the cake within 48 hours of cutting.

            12.2. We will advise you depending on the type of cake you have as to whether it requires refrigeration.

       12.3. After 48 hours we advise sponge cakes are frozen if you wish to prolong the life of your cake, but it would need to be consumed immediately after defrosting. Freezing the cake preserves the taste of the sponge and icing as much as feasibly possible, but it will affect the visual appearance of the icing, as condensation will form upon defrosting. Food hygiene recommendations recommend that food should only be frozen for a maximum of 3 months. The cake should be wrapped in clingfilm to remove as much air as possible, then stored in an airtight container before freezing for a maximum of 3 months, the best action would be to cut the cake into portions and freeze.

           12.4. Our cakes are made entirely of natural ingredients, therefore they will not have the extended shelf life of most supermarket cakes, which contain additives and preservatives to ensure their prolonged life.


13.   Additives and Colourings

           13.1  Our products may contain some or all of the following additives and colourings that may have adverse effects in children.

E110, E124, E171, E104, E133, E102, E551, E406, E330, E122, E202, E155


14. Complaints

        14.1. If you have concerns about your cake, please notify us upon delivery/inspection so that we can rectify it in time for your event.

            14.2. All other concerns should be made in writing, and evidence of the fault should be included.

           14.3. A refund is only given if the uneaten cakes are returned and are unsuitable for consumption/not as described in the written quote. No refunds are given due to change of mind.
